Civil liability action against Casino and several senior executives - Dissemination of false and misleading information and breaches of financial disclosure obligations

Civil liability action against Casino and several executives on behalf of shareholders and bondholders, for the alleged dissemination of false and misleading information, supported by a forensic review of the group's accounts.

Background

We represent a group of shareholders and bondholders of Casino and its parent company Rallye in a tort-based civil liability action brought against Casino and certain senior executives of the group. The claim seeks compensation for financial losses sustained as a result of the alleged dissemination of false and misleading information, in breach of statutory financial disclosure obligations.

The case is grounded in a detailed forensic review of Casino's financial statements and public disclosures, revealing significant discrepancies between management's representations and the company's actual economic and accounting situation.

Experience

We are leading the litigation in all its dimensions—both legal and technical. Our role includes developing the overall litigation strategy and conducting a thorough review of Casino's financial reporting over several fiscal years.

Working alongside these experts, we have identified a number of major accounting irregularities (including revenue recognition practices, treatment of intangible assets, and trade receivables) that contributed to a materially distorted presentation of the group's financial position. These findings are framed within a rigorous legal analysis based on the principles governing tort liability for dissemination of misleading information.

Our legal arguments are structured to establish the liability not only of the company but also of certain executives, based on their personal involvement in, or knowledge of, the misconduct. This case reflects our broader practice in high-stakes securities litigation, combining legal analysis, financial expertise, and in-depth understanding of market practices.

Sophie Vermeille was interviewed by Les Échos, which produced a video outlining the main aspects of the case.
